Guest Terms

These Guest Terms apply when you browse, purchase, attend, score, vote, or use gift cards or tickets through the Asemblie platform. They supplement the Asemblie Terms of Service, which are incorporated by reference. Where these Guest Terms conflict with the Terms of Service on a guest-specific matter, these Guest Terms control.


1. WHO YOU ARE BUYING FROM

When you buy through Asemblie, you are buying from the Vendor or Organizer — not from Asemblie.

Asemblie provides the software that lets you discover vendors, browse products, build a cart, and pay. The seller of the goods is the Vendor or Organizer listed on the booth. Your contract for the goods is with them. They are responsible for the product, its accuracy, its safety, its availability, and its fulfillment.

Asemblie does not inspect, handle, store, or take ownership of any product sold through the Service.


2. ACCOUNTS AND BROWSING

You may browse events, view vendors and products, and in many cases score or vote without creating an account. In that case we associate your activity with an anonymous browser session rather than a named account.

Creating a Guest account lets your passport stamps, vendor follows, subscriptions, gift cards, and preferences persist across events and devices. You must be 18 or older to create an account or make a purchase. If you are between 13 and 18, you may use the Service only with a parent or guardian's involvement, and they must make any purchase on your behalf.


3. ORDERS AND PAYMENT

Placing an order. When you complete checkout, you are making a binding offer to purchase from the Vendor. The order is confirmed when the Vendor accepts it or the Service confirms it on their behalf.

Prices. Prices are set by the Vendor and displayed before checkout. Where an item is sold by weight or unit, the final amount may vary from the estimate shown; any variance will be disclosed before you are charged, or adjusted in accordance with the Vendor's policy.

Payment. Payments are processed by Stripe. Asemblie does not store your full card number. Accepted methods include card, Apple Pay, Google Pay, and Asemblie gift cards, subject to availability.

Fees. A platform or service fee may be added at checkout and will be disclosed before you pay.

Pickup. Most orders are fulfilled by pickup at the Vendor's booth during event hours. You are responsible for collecting your order during those hours. If you do not collect an order you paid for, the Vendor's refund policy governs.


4. REFUNDS, CANCELLATIONS, AND PROBLEMS WITH AN ORDER

Vendor policy governs. Each Vendor sets their own refund policy. If a Vendor has not published one, they have agreed to refund any order they cannot fulfill.

Perishable goods. Food, produce, and other perishable items are frequently non-refundable once collected. Check the Vendor's policy before purchasing.

Who to contact. Raise any problem with an order — wrong item, missing item, quality, or non-delivery — with the Vendor first. Asemblie can provide your transaction record but cannot compel a Vendor to refund, and is not a party to the sale.

Event cancellation. If an event is cancelled or postponed, the Organizer determines refunds for admission or tickets they sold. Asemblie does not guarantee refunds for a cancelled event and is not responsible for an Organizer's failure to refund.

Chargebacks. If you dispute a charge with your bank, the disputed amount is debited from the Vendor. Please attempt to resolve the issue with the Vendor before initiating a chargeback.


5. GIFT CARDS

Asemblie gift cards are issued by Asemblie, Inc. and may be redeemed toward purchases from participating Vendors and Organizers on the Service.

No expiration. Asemblie gift card funds do not expire.

No fees. We do not charge purchase fees, dormancy fees, inactivity fees, or service fees on gift cards.

Not redeemable for cash. Gift cards are not redeemable for cash except where required by applicable state law. Some states require cash redemption of balances below a specified threshold; if your state does, we will honor that requirement on request.

How to use. Apply a gift card at checkout. If your order exceeds the card balance, you pay the difference with another method. If your order is less than the balance, the remainder stays on the card.

Claiming. Gift cards may be claimed by the recipient email address or by entering the code. Keep your code secure — anyone with the code can redeem the balance. Treat it like cash. We are not responsible for lost, stolen, or shared codes, and we cannot restore a balance redeemed by someone who obtained your code.

Refunds on gift card purchases. A gift card purchase may be refunded to the original purchaser only if the card has not been claimed or redeemed. Once redeemed, that value is not refundable to the purchaser.

Not a general-purpose instrument. Gift cards may be used only within the Asemblie Service. They are not credit cards, debit cards, bank accounts, or general-purpose reloadable cards, and they carry no interest and no FDIC insurance.

Void where prohibited. Gift cards are void where prohibited by law.


6. COMPETITION TICKETS AND EVENT ADMISSION

Where the Service sells admission to a competition or event:

  • The Organizer is the seller. Asemblie facilitates the sale; the Organizer runs the event.
  • Tickets are valid only for the specific event, date, and time listed.
  • Refunds are governed by the Organizer's policy. Where an event is cancelled by the Organizer, the Organizer is responsible for refunds.
  • Do not resell. Tickets may not be resold above face value or transferred for commercial purposes without the Organizer's permission.
  • Keep your code secure. A ticket code or QR code may be redeemed once. Anyone who presents it may be admitted.
  • Admission is at the Organizer's discretion, subject to venue rules, capacity, and conduct.

7. SCORING, VOTING, AND COMPETITIONS

Where you score entries, vote, or rate vendors:

  • Vote honestly and based on your own experience
  • One vote per entry per person. Do not vote through multiple accounts, devices, or browser sessions to influence a result
  • Do not accept or offer anything of value in exchange for a vote
  • Do not interfere with another entrant's participation

Results. Scores are aggregated and displayed on leaderboards, including across multiple events where applicable. Asemblie does not certify, audit, or guarantee results, and does not award prizes. Competition rules, eligibility, judging, prizes, and result disputes are the Organizer's responsibility.

We may remove votes, exclude sessions, or adjust displayed results where we detect manipulation.


8. ATTENDING EVENTS — YOUR RISK

Asemblie does not run events. We do not own venues, staff events, provide security, inspect food, or control who attends.

You attend any event at your own risk. Asemblie is not responsible for: venue conditions, weather, cancellation, injury, illness (including foodborne illness), theft, lost property, the conduct of other attendees, or any dispute with an Organizer or Vendor at the event.

Allergies and dietary restrictions. Product descriptions are written by Vendors and may be incomplete. If you have a food allergy or dietary restriction, confirm ingredients directly with the Vendor before consuming anything. Do not rely solely on a listing.


9. YOUR CONDUCT

You agree not to: manipulate votes or ratings; use the Service to harass any Vendor, Organizer, or Guest; submit false or defamatory reviews; use automated tools to purchase or scrape; attempt unauthorized access; or use the Service unlawfully.

We may suspend or terminate access, cancel orders, void gift cards obtained fraudulently, and remove content for violations.


10. PRIVACY

Your information is handled per the Asemblie Privacy Policy. Note in particular that when you place an order, the selling Vendor receives the information needed to fulfill it, and when you send a gift card, the recipient receives the email address and message you provide.


11. DISCLAIMERS AND LIABILITY

The disclaimers in Section 8 and the limitation of liability in Section 9 of the Terms of Service apply to your use of the Service as a Guest and are incorporated here.

In particular: Asemblie is not liable for the quality, safety, or delivery of any product, for any event, or for the conduct of any Vendor, Organizer, or attendee. Claims about a product or an event should be directed to the seller or Organizer.


12. GENERAL

Changes. We may update these Guest Terms with notice through the Service. Continued use after the effective date constitutes acceptance. Changes do not retroactively affect completed orders or previously issued gift cards.

Governing law and venue. Florida law governs, with venue as set out in the Terms of Service.
